With Urban Explorers still seeking to gain access to the estate (to view redundant buildings), we reiterate our request to all owners of such properties, and in the surrounding area (which may provide access routes), to make sure that all boundary fencing is properly secure.
Whilst some may feel it is for the Residents’ Association to secure the boundaries of the estate, the Residents’ Association’s obligations and resources are restricted to the communal areas of the estate. Instead, in accordance with the respective property deed, it is an individual owner’s responsibility to ensure their respective boundary is secure; and, by each owner playing their part, help ensure the total integrity of the estate.
This obligation is particularly important for those properties that directly abut the open ground between the estate boundary and the Seven Hills Road, as this is where Urban Explorers are continuing to seek to gain access.
In the interest of the collective security of the estate, each owner is therefore requested, and required under the deed obligations, to ensure boundary fencing is secure such that trespassers cannot gain entry onto the estate.
If then Urban Explorers break a fence to gain access this becomes a criminal offence, and the Police can take action. Currently we are restricted – as, although our security can respond and escort the Urban Explorers off the estate, they cannot be charged by the Police as trespass is a civil offence.
The swift cooperation of owners to ensure all boundary fencing is secure would be very much appreciated – as it would help address this current irritation and be in the collective interests of all residents.
